TERMS AND CONDITIONS OF USE
By licensing downloaded video content from OneMissionTV, LLC, user agrees to the following terms and conditions.
OneMissionTV, LLC has the right to modify this License Agreement at any time. The version of this License Agreement in effect at the time of the End User’s purchase shall govern. Any modifications made by OneMissionTV, LLC to these terms and conditions shall be prospective only. Modifications to the terms and conditions shall be effective immediately upon posting to www.onemission.tv.
TERMS OF USE
User may not resell, give away, share, reproduce or redistribute the downloaded video content in any way.
Downloaded videos are licensed for public viewing before a live audience at one location only within the United States (or within a country which is a party to the Berne Convention for the Protection of Literary and Artistic Works, or to the Universal Copyright Convention), and may not be used, in whole or in part, in any other manner, including but not limited to as radio, television, cable, print, or internet content without the express written permission of OneMissionTV, LLC and any other person controlling content copyrights or other intellectual property.
Downloaded TV and Radio commercials may be broadcast.
User may not make additional copies of downloaded video content, except that user may make and keep one copy of a video clip, in addition to the original downloaded video, for backup or archival purposes.
User may not edit, modify, or alter the downloaded video content in any manner. Downloaded TV and Radio commercials may be modified only by adding customized church or organization information at the end of the commercial. TV and Radio commercials may not be edited, modified or altered in any other manner.
User agrees to abide by laws governing trademarks, service marks, copyrights, intellectual rights, proprietary rights, and licensing requirements for usage of the downloaded video content.
User may not transfer the license or any downloaded video content to any other person or entity, including sharing of the video content without compensation, without the written permission of OneMissionTV, LLC and any other person controlling content copyrights or other intellectual property.
If User violates the terms of this Agreement, or if OneMissionTV, LLC has reasonable cause to believe that User has violated or intends to violate the terms of this Agreement, OneMissionTV, LLC has the right to suspend or terminate User’s account and to suspend temporarily or terminate User’s license to use the downloaded video content. Immediately upon notification that User’s license has been suspended or terminated, User agrees to cease use of the downloaded video content, until User is notified that their license has been reinstated.
CHANGES TO PRODUCTS OFFERED
Products and services offered are subject to change without notice. Access to some or all of the products and/or services offered may be available only through registration on our website.
USER ACCOUNT
OneMissionTV, LLC will accept User accounts only from individuals who are of legal age to form a binding contract or from legal representatives of organizations or other entities based in the United States (or within a country which is a party to the Berne Convention for the Protection of Literary and Artistic Works, or to the Universal Copyright Convention). By applying for a User account, User represents that he or she is of legal age and, if applying on behalf of an organization, User represents that he or she is authorized by the organization to enter into a contract on the organization’s behalf.
User agrees to provide accurate and complete personal and organization information as requested in OneMissionTV, LLC's registration form and to update the information as needed. Failure to provide accurate information may result in termination of the account.
INDEMNITY
User agrees to indemnify, defend, and hold harmless OneMissionTV, LLC, its officers, directors, employees, and affiliated third parties from any claim, demand, or liability, including reasonable attorneys’ fees, made by any third party due to or arising out of User’s use of the downloaded video content or User’s breach of this Agreement.
USER LIABILITY AND WARRANTY DISCLAIMER
User agrees that downloaded video content is used at user’s own risk. Downloaded video content and the related OneMissionTV, LLC services are provided as is, without warranty of any kind. OneMissionTV, LLC makes no warranty that the downloaded video content will be without error, that it will meet User’s specific purpose or requirements, or that it will be compatible with User’s computer systems. User agrees to be fully responsible for any damages or loss of data to User’s computer systems that may occur from the use of the downloaded video content.
OneMissionTV, LLC's liability for any damages arising from User’s use of the downloaded video content and related OneMissionTV, LLC services is limited to refund of the license price paid by User for the downloaded video content.
GOVERNING LAW
This Agreement is governed by the law of the State of Georgia.
